Acceptance and website scope

These Terms of Use (“Terms”) are an agreement between you and Innotent LTD governing your access to and use of the public Plant ID website. By accessing or using the website, you agree to these Terms. If you do not agree, please do not use the website.

These Terms apply to the website’s plant encyclopedia, articles, search features, and related public pages. The website currently does not offer public accounts, purchases, comments, contact-form submissions, or photo uploads.

These Terms do not govern the Plant ID mobile application or features offered within the app, including accounts, community features, subscriptions, or in-app purchases. Separate terms apply to the mobile app.

Eligibility and guardian permission

You may use the website only if you can legally agree to these Terms under the law that applies to you.

If you are not legally able to agree to these Terms on your own, a parent or legal guardian must review and agree to them for you and supervise your use of the website. A parent or guardian who permits such use accepts responsibility for that use.

Acceptable use and security

You must use the website lawfully and in a way that does not harm the website, its visitors, or other people or systems.

• Do not break the law. Do not use the website for unlawful, fraudulent, abusive, or harmful activity or to violate another person’s rights.
• Do not compromise security. Do not attempt to gain unauthorized access, bypass security measures, probe for vulnerabilities, or access data or systems that are not intended for you.
• Do not disrupt the website. Do not introduce malicious code, overload infrastructure, interfere with normal operation, or prevent others from using the website.
• Do not misrepresent your relationship with us. Do not claim that Innotent LTD endorses, sponsors, or is affiliated with you unless we have agreed to that in writing.

Plant information and safety

The website provides general educational information about plants, identification, toxicity, health, disease, treatment, and care. Plant characteristics and needs vary, and website content may be incomplete, outdated, inaccurate, or unsuitable for a particular plant, person, animal, climate, location, or situation.

Website content is not professional botanical, horticultural, agricultural, medical, veterinary, toxicological, poison-control, or pest-control advice. It is not a substitute for examining a plant or situation directly or consulting an appropriately qualified professional.

You are responsible for checking plant identities, warnings, instructions, product labels, local rules, and recommendations against reliable sources before acting. Care and treatment outcomes are never guaranteed.

Availability and access

We may add, remove, correct, update, suspend, restrict, or discontinue any part of the website at any time. We do not promise that any content or feature will remain available, current, complete, or unchanged.

The website may sometimes be unavailable or affected by errors, maintenance, security events, network conditions, or circumstances outside our control.

We may restrict or block access when we reasonably believe it is necessary to protect the website, enforce these Terms, comply with law, investigate misuse, or prevent harm. Where appropriate, we may cooperate with lawful requests from authorities.

Third-party links and mobile app

The website may link to the App Store, the Plant ID mobile app, and other websites, products, content, or services operated by third parties. Links are provided for convenience and do not mean that we control or endorse everything available through those destinations.

Your use of a third-party destination is governed by that party’s terms and policies. To the fullest extent permitted by law, Innotent LTD is not responsible for third-party availability, content, security, privacy practices, products, services, transactions, or resulting loss.

Downloading or using the Plant ID mobile app, creating an app account, participating in app community features, and purchasing or managing an app subscription are outside these website Terms and are subject to the separate terms presented for the app and any applicable app-store rules.

Warranties and liability

No warranties

To the fullest extent permitted by applicable law, the website and all information and features available through it are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory.

We do not warrant that the website will be accurate, complete, current, uninterrupted, error-free, secure, or suitable for your needs, or that any defect will be corrected or any result will be achieved.

Exclusion of liability

To the fullest extent permitted by applicable law, Innotent LTD and its directors, officers, employees, contractors, and service providers will not be liable for any loss, injury, claim, or damage arising out of or related to the website, these Terms, your inability to use the website, or your use of or reliance on any website information.

This exclusion applies to direct, indirect, incidental, special, consequential, exemplary, and punitive loss or damage, including harm to plants, people, animals, or property and loss of data, opportunity, business, revenue, profits, or goodwill, regardless of the legal theory asserted and even if the possibility was known.

Nothing in these Terms excludes or limits any liability, remedy, guarantee, or consumer right that applicable law does not allow us to exclude or limit. Where an exclusion is not permitted, it applies only to the maximum extent permitted by law.

Privacy

Our Privacy Policy explains how Innotent LTD handles personal data in connection with this website, including technical information, emails, cookies, and analytics choices. The Privacy Policy is a separate notice and does not expand the scope of these Terms to the mobile app.

Governing law and disputes

These Terms and any dispute or claim arising out of or relating to them or the website are governed by the laws of the State of Israel, without regard to conflict-of-law rules.

Subject to any mandatory law that applies to you, the competent courts located in Tel Aviv-Jaffa, Israel will have exclusive jurisdiction over such disputes and claims.

Nothing in this section removes a consumer protection, right, remedy, or right to bring or defend proceedings in another forum where the law applicable to you does not allow that protection or right to be waived.

Changes and contact

Changes to these Terms

We may update these Terms to reflect changes in the website, our practices, or applicable law. We will publish the revised Terms on this page, update the date at the top, and provide additional notice where appropriate. Changes apply from the stated effective date, and your continued use after that date means you accept the revised Terms.

Standard legal provisions

These Terms constitute the entire agreement between you and Innotent LTD concerning your use of this website. If a provision is found unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in effect.

A delay or failure to enforce a provision is not a waiver of our right to enforce it later. Section headings are provided only for convenience and do not affect interpretation.
